Terms and Conditions

1. The Service

LayanLeads provides AI agents that respond to and manage conversations with your customers on WhatsApp and other channels, including answering enquiries, booking appointments, selling products and collecting reports into tools such as Google Sheets. Features may change as we improve the Service.

2. Eligibility and accounts

• You must be at least 18 years old and able to enter a binding contract, and you must use the Service for business purposes.
• If you sign up on behalf of a business, you confirm you are authorised to bind that business to these Terms.
• You must give accurate information when registering at ai.layanleads.com and keep your login details secure. You are responsible for all activity under your account.

3. Subscriptions, fees and payment

• Paid plans are billed in advance on a recurring basis at the prices shown in the app at the time of purchase. Prices are in Malaysian Ringgit unless stated otherwise and exclude applicable taxes.
• Subscriptions renew automatically until cancelled. You can cancel at any time in the app; cancellation takes effect at the end of the current billing period.
• Except where required by law, fees already paid are non-refundable.
• We may change prices with at least 30 days' notice. Changes apply from your next billing period.
• If payment fails, we may suspend the Service until the outstanding amount is paid.

4. Acceptable use

You agree not to use the Service to:

• Send spam, unsolicited bulk messages, or messages to people who have not agreed to hear from you.
• Breach WhatsApp / Meta policies, or any law, including consumer protection, advertising and personal data protection laws.
• Send unlawful, fraudulent, misleading, harassing, hateful or infringing content, or promote prohibited goods or services.
• Interfere with, reverse engineer, overload or gain unauthorised access to the Service or its systems.
• Resell or sublicense the Service without our written permission.

We may suspend or terminate accounts that breach this section.

5. Your content and data

• You own the content and data you upload or that is generated through your conversations ("Your Content"). You grant us a licence to host, process and use Your Content only as needed to provide, secure and improve the Service.
• You are responsible for Your Content and for having the right and any required consents to collect and share your customers' personal data with us.
• We handle personal data as described in our Privacy Policy.

6. AI-generated responses

The Service uses artificial intelligence. While we train and configure our agents to be accurate, AI responses may sometimes be incomplete, incorrect or inappropriate. You are responsible for reviewing your agent's configuration, the information you provide to it, and the commitments it makes to your customers. You should not rely on the Service for medical, legal, financial or other professional advice, or for emergencies.

7. Third-party services

The Service relies on third-party platforms such as WhatsApp / Meta, Google, AI model providers and payment processors. Your use of those platforms is subject to their own terms. We are not responsible for their availability, changes or actions, including any restriction of your WhatsApp number or account by Meta.

8. Intellectual property

The Service, including the LayanLeads name, logo, software, AI agents (including Cici) and website content, is owned by Stark Automate Solutions or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription in accordance with these Terms.

9. Availability and changes

We aim to keep the Service available but do not guarantee it will be uninterrupted or error-free. We may carry out maintenance, and we may modify, suspend or discontinue features, giving reasonable notice where practical.

10. Disclaimer

To the fullest extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose, and we do not guarantee any particular sales, bookings or business results.

11. Limitation of liability

To the fullest extent permitted by law, Stark Automate Solutions will not be liable for any indirect, incidental, special or consequential loss, or for loss of profits, revenue, data or goodwill. Our total liability arising from or relating to the Service is limited to the fees you paid us in the three (3) months before the event giving rise to the claim.

12. Indemnity

You agree to indemnify Stark Automate Solutions against claims, losses and costs arising from Your Content, your use of the Service, or your breach of these Terms or any law.

13. Termination

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access if you breach these Terms, fail to pay, or if required by law or a third-party platform. On termination, your right to use the Service ends, and we may delete Your Content after a reasonable period in line with our Privacy Policy.

14. Changes to these Terms

We may update these Terms from time to time. We will post the updated version on this page with a new "Last updated" date and, for material changes, notify you through the app or by message. Continued use of the Service after changes take effect means you accept the updated Terms.

15. Governing law

These Terms are governed by the laws of Malaysia. Any dispute will be subject to the exclusive jurisdiction of the courts of Malaysia.
